This website at funbomb.com is operated by Funbomb Inc, a California corporation, at 1732 Aviation Blvd. #102, Redondo Beach, CA 90278. In these terms, "Funbomb," "we," "us" and "our" mean Funbomb Inc. "You" means anyone who visits or uses this site.

2. Accepting these terms

By using this site you agree to these terms. If you do not agree, do not use the site. We may update these terms at any time, and the version posted here is the one that governs. The "last updated" date above changes when we revise them. Continuing to use the site after a change means you accept the revised terms.

3. What this site is and is not

This site describes Funbomb's production, directing and production services work. Nothing on it is an offer, a bid, a quote, or a commitment to provide services. Rates, scopes, schedules and deliverables are set only in a signed written agreement between Funbomb and a client. No engagement, retainer, agency, partnership or employment relationship is created by visiting this site, sending an email through it, submitting a brief, or booking a call.

4. Our content

The text, design, photographs, footage, logos, marks and layout on this site are owned by Funbomb Inc or used with permission and are protected by copyright and trademark law. You may view the site and share links to it. You may not copy, reproduce, republish, scrape, sell, or create derivative works from any of it without written permission.

Client names, brand marks and logos shown on this site belong to their respective owners. They appear to identify work Funbomb has produced or contributed to. Their appearance is not a claim of ownership and does not imply those companies endorse, sponsor or are affiliated with Funbomb.

Film and project stills, clips and titles appear for the purpose of identifying credited work. All rights in those underlying works remain with their respective rights holders.

5. Your submissions through this site

Where the site lets you send something to us, including the brief form, the newsletter signup, email links and booked calls, you agree that what you send is accurate, that you have the right to send it, and that it does not infringe anyone else's rights or break any law.

Do not send confidential information through this site. Nothing you send through a web form or an unencrypted email is confidential, and no confidentiality obligation arises from your sending it. If a project requires confidentiality, we will sign an NDA before you send the material.

6. Unsolicited submissions

Funbomb Inc does not accept, review, or consider unsolicited creative material. This includes, without limitation, scripts, screenplays, treatments, loglines, synopses, outlines, story ideas, concepts, formats, characters, artwork, music, footage, pitch decks and proposals, whether submitted by post, email, web form, direct message, or any other means.

If you send unsolicited material anyway, you agree that:

• it is not submitted in confidence, and no confidential or fiduciary relationship is created by sending it;
• we are under no obligation to review it, respond to it, return it, or keep it;
• we do not forward it to third parties;
• we may already be developing, or may later independently develop, material that is the same as or similar to yours, from our own sources or from others, with no obligation, compensation or credit owed to you.

Nothing in this section limits any separate written agreement between you and Funbomb. If we have asked you to send something, it is not unsolicited and this section does not apply to it.

7. Privacy

What gets collected

We collect what you give us and what the site records automatically.

What you give us: your name, email address, phone number, company, and whatever you write when you send a brief, subscribe to the newsletter, book a call, or email us.

What the site records automatically: IP address, browser and device type, referring page, pages viewed, and time on page, through cookies and similar technologies.

What it is used for

To answer you, to quote and deliver work, to send the newsletter if you asked for it, to keep the site working and secure, and to meet our legal and accounting obligations. We do not sell your personal information and we do not share it with anyone except service providers who help us run the business, such as our website platform, email delivery, scheduling and accounting providers, each under their own obligations to protect it, or where we are required to by law.

What's Good goes out to people who asked for it. Every issue has an unsubscribe link and it works immediately.

How long we keep it

As long as we need it for the purpose it was given, and after that as long as we are required to keep it for legal, tax or accounting reasons.

Your rights in California

If you live in California, the CCPA as amended by the CPRA gives you the right to know what personal information we have collected about you, the right to have it deleted, the right to correct it, the right to limit how sensitive personal information is used, and the right not to be discriminated against for exercising any of those rights. We do not sell or share personal information as those terms are defined under that law. To make a request, email [email protected]. We may need to verify who you are before acting on it.

Children

This site is for business use and is not directed to children under 13. We do not knowingly collect personal information from children under 13.

8. Third party links

This site links to other sites, including social platforms, scheduling tools and video hosts. We do not control them and we are not responsible for their content or their privacy practices. Their terms govern once you leave.

9. No warranty

This site is provided as is and as available. To the fullest extent the law allows, Funbomb disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error free, or free of harmful components, or that anything on it is complete, current or accurate.

10. Limitation of liability

To the fullest extent the law allows, Funbomb Inc and its officers, employees and contractors are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, data, goodwill or business opportunity, arising out of your use of this site, whatever the theory of liability and even if we were advised such damages were possible.

11. Indemnity

You agree to indemnify and hold harmless Funbomb Inc and its officers, employees and contractors from any claim, demand, loss, liability, cost or expense, including reasonable attorneys' fees, arising out of your use of this site, your breach of these terms, or anything you submit through the site.

12. Governing law and disputes

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of these terms or this site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to those courts' jurisdiction.

13. Accessibility

We want this site usable by everyone. If you run into a barrier, email [email protected] and tell us what happened and where, and we will work to fix it.

14. Miscellaneous

If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. These terms, together with any signed agreement between us, are the entire agreement about your use of this site.
